Valencia inheritance tax is declared unconstitutional

The Constitutional Court declared that the Inheritance Tax Law applicable in Valencia goes against the Constitution because tax benefits are only available for those residing in the Community of Valencia. This is a new step because it considers the Law discriminatory for Spanish people also, and opens the door for the change in the legislation of the rest of the Communities.

A claim for tax refund can be made now if it has not elapsed more than 4 years since the date of submission of the declaration. A damage claim before the public administration can also be started for those who fall out of the 4 years period, within 1 year since the declaration of unconstitutional.
